ML sues TT today. Apparently, TT is claiming sovereign immunity. I am skeptical a state entity can cliam sovereign immunity on a contract claim, but what do I know? If they can, why would anybody sign a contrct with them? I sure as hell wouldn't if I knew they could just screw me and walk away. I hope ML causes them a lot of grief, but he is going to make himself toxic and he has probably coached his last D1 game. See, Richardson, Nolan.

you can claim anything...... i don't think that would be a valid defense for a contract claim. It is a valid defense for a tort claim. Their best argument is to have defenses that he breached the contract....
 
I believe this is what the judge in the Churchill case eventually used to justify giving Ward-o the high hard one.

I think Leach probably gets a good chunk of change out of them. The question, IMO, is whether they are willing to fight to the death (and likely expose some unsavory actions not only on Leach's part, but on the part of their administration and boosters), or if they pay him off a settlement. I think they'll settle.

ML is crazy enough to go Swashbuckling Pirate all the way to trial. This is going to be funny.
 
I do not know the details.... i may have a boring day tomorrow and can research it..... But Ward may have tried a tort claim and a contract claim..... a lawyer will try both for a settlement.... the tort has more upside potential.....

Both are fact specific related to a document (contract) that I am not privy to... so it is hard to give an educated answer...
 
Sovereign immunity? i know Texas has some ****ed up laws but I can t see that as being a viable defense.
 
$800k was only the bonus he was due on 12/31. I don't know what the buyout amount was.

If he gets the bonus plus some of the buyout, that would be closer to $800k than $1, so technically what Skiddy threw at the wall stuck.... :lol:
 
There seems to be a lot of messy documentation from Tech's emails that may make a case for Leach like it did for Neuheisal, despite the fact Leach's attorney looks shlockey (is that a word).

The Faux Indian's lawsuit alleged that CU retaliated against him for exercising his First Amendment right to free speech. He did not allege a contract claim. And he did not allege a tort (based on an illegal employment discharge) since the Colorado Governmental Immunity Act would have severely restricted CU's liability (and any potential award of damages).

TT's assertion of "sovereign immunity" (on which state governmental immunity statutes are based of course) is pre-litigation smoke and mirrors which will not hold water ... as I'm sure you'll agree. :smile:

There are some unconfirmed rumors floating around that the Pirate Lord himself has dropped anchor in Boulder at the moment. I have no idea if this is true but it's out there in the twitter-verse right now.
