PSU AD charged with perjury, ex-DC indicted on felony sex crimes against minors

Penn State Athletic Director Tim Curley and senior administrator Gary Schulz have been charged with perjury and failure to report a crime during the investigation of former defensive coach Jerry Saundsky.



The information was posted to the state Attorney General's website this morning, as Sandusky was being arraigned on 40 charges related to sex crimes against kids.

Sources also tell The Patriot-News that head coach Joe Paterno will not be charged.


he perjury charges against Curley and Schultz are third-degree felonies, punishable by up to seven years in prison. Failure to report is only a summary offense, like a traffic ticket.

Tim Curley has been athletic director since 1993, and held his post when allegations were reported to Penn State police in 1998.

Schultz retired from his position in 2009, and returned temporarily to the job while a national search was being conducted.

Attorney General Linda Kelly says Curley and Schultz perjured themselves by repeatedly denying, during the grand jury investigation, that they were told about an incident in 2002 that was reported by a graduate football assistant who walked on Sandusky taking a shower with a young boy.


Sex abuse charges have been filed in Centre County against Penn State coaching legend and Second Mile charity founder Jerry Sandusky.

The charges follow a more-than two year grand jury investigation that began when a Clinton County teen alleged inappropriate contact against the 67-year-old former coach.

During the investigation, older allegations from 1998 surfaced as well. In the older case, Penn State police investigated inappropriate touching in a shower.

The charging paperwork has not yet made it to the District Magistrate Judge's office in Centre County. However, felony charges of involuntary deviate sexual intercourse of someone under 16, aggravated indecent assault, indecent assault of someone under 16, indecent assault of someone under 13, and corruption of minors charges have been filed in the state court docket system.

The offense dates include 1996, 1998, 2000, 2002, and 2005. There are 40 counts included in the paperwork filed against him.

Have to agree with you. If Joe Pa didn't know about this considering the number of years it was allegedly happening and as close as he worked with Sandusky then he has no business being in charge of a program like Penn States.

This kind of behavior is absolutely inexcusable and I hope that anyone who is shown to have any knowledge of it and didn't report gets penalized to the full extent of the law.

The quick action by high school staff members in Clinton County in response to reports of a possible sexual assault by Sandusky is in marked contrast to the reaction of top officials at Penn State University, who had actually received a first-hand report of a sexual attack by Sandusky seven years earlier.
"One of the most compelling and disturbing pieces of testimony in this investigation came from an eyewitness to a late-night sexual assault that allegedly occurred in March of 2002, in the locker room of the Lasch Football Building on the University Park Campus," Kelly said. "Hearing what sounded like sexual activity in the showers of a building that was supposed to be empty, a graduate assistant reportedly observed Sandusky sexually assaulting a naked boy who appeared to be about 10 years old."

According to the grand jury, the graduate assistant had returned to the football building that evening to put a new pair of sneakers in his locker and to retrieve some recruiting films, only to be surprised that the lights were on in the locker room and showers were running. The assistant immediately recognized Sandusky.

Kelly said the assistant, who was extremely upset about what he had seen, immediately called his father to relate what he had discovered. Together, the two decided that the assistant should promptly report the incident to head football coach Joe Paterno.

The next morning, the assistant telephoned Paterno and then went to Paterno's home to explain what he had seen. Paterno testified that he then called Penn State Athletic Director Tim Curley and met with Curley the following day, explaining that a graduate assistant had reported seeing Sandusky involved in sexual activity with a young boy in the showers at the Lasch Building.

Kelly said that approximately one and a half weeks later, the graduate assistant was called to a meeting with Curley and Gary Schultz, who was Senior Vice President for Finance and Business at the University. At that time, the assistant again recounted what he had witnessed Sandusky doing to a young boy in the showers of the football locker room.

"Despite a powerful eyewitness statement about the sexual assault of a child, this incident was not reported to any law enforcement or child protective agency, as required by Pennsylvania law," Kelly said. "Additionally, there is no indication that anyone from the university ever attempted to learn the identity of the child who was sexually assaulted on their campus or made any follow-up effort to obtain more information from the person who witnessed the attack first-hand."
Kelly said that rather than reporting the matter to law enforcement, Curley and Schultz agreed that Sandusky would be told he could not bring any Second Mile children into the football building. That message was also reportedly related to Dr. John Raykovitz at the Second Mile (Past Executive Director and Executive Vice-President and currently the President and CEO of the Second Mile).
"Despite this so-called 'ban', which was reviewed and approved by University President Graham Spanier without any further inquiry on his part, there was no effective change in Sandusky's status with the school and no limits on his access to the campus," Kelly said. "Sandusky's 'emeritus' position, alleged negotiated as part of his 1999 retirement, provided him with an office in the Lasch Football Building; unlimited access to all football facilities, including the locker room; access to all recreational facilities; a parking pass; a university Internet account; listing in the faculty directory and numerous other privileges - he had remained a regular presence on campus."

Seems like Joe Pa reported it to the AD but the AD kept him on. Maybe Joe Pa covered his tracks better.

I don't know what the law is in Pennsylvania and it also may be different for university level employees than for K-12 but Colorado law not only requires that I report any potential activity of this nature but also that I follow through to insure that it reaches the approapriate authorities at the child protective services level.

This is the first I have heard of this incident but from what you have posted I get a strong feeling that what is not being reported is a lot more than what is. This could and potentially should be the end of JoePa at PSU.

The info you posted indicates that these incidents were happening prior to his retirement and after and that he had full access to PSU facilities and was frequently in and around the AD facilities.

Again I don't know Pennsylvania law but if these PSU officials are on mandatory report status it doesn't matter if Sandusky is retired or even affiliated with the university, the only question is if a real or potential risk to a child or children exist.

don't know. Also sandusky's son was at penn state (safety now Cleveland Browns head of personnel) playing during that time and graduated in 99. Lot of issues here.

And again in 2002, when they get unlucky enough to have a grad assistant with a conscience walk in on him. So he goes to Paterno and tells him Sandusky likes to **** around with young boys. Paterno goes to Curley and they are shocked! SHOCKED!! to know Sandusky does this. Well, maybe just to know that he still does this. They tell him, essentially, to do it somewhere else. Which, apparently he does in 2005 (and maybe 2009? Can't quite tell if there was another assault then, or that's just when somebody came forward).

Now, maybe the school managed to investigate Sandusky and shuffle him off into "retirement" without Paterno ever knowing what was going on. Maybe nobody told him why his key assistant was retiring in the prime of his career. Nothing in the articles seems to say that Paterno ever lied about not knowing about Sandusky getting caught in the shower with the kid, which is what Curley and Schulz are being charged with. But there is no way around the fact that Paterno knew about Sandusky in 2002, and went along with not getting him charged. You have to believe he actually knew about it in 1999, and went along with covering it up, and allowing Sandusky basically full access to University facilities. And you have to wonder what he may have known before then. Because Curley and Schulz and Paterno allowed Sandusky to get away without being charged at least twice, he was able to assault more young men. If they can live with themselves knowing that, they are seriously ****ed up human beings. Which they are, to go along with this in the first place.

I'm sure the same media jackals that ruined Gary Barnett over things that occurred outside his watch will go just as hard after dear, sweet JoePa. Right? I'm sure they'll be just as outraged that he directly helped protect a child molester as they were that Barnett wasn't out at a Boulder apartment stopping his players from being drunk, horny and stupid. Right??

Well, maybe if JoePa insults a girl kicker?????

Where is a politically motivated bitch assistant DA when you need her. This would be a real case she could pursue and actually help something but it won't happen.

Most likely if they can't sweep it under the rug Joe Pa retires for "health reasons"

Seriously, WTF. I'm glad he reported THE NEXT MORNING, rather than not at all, but holy crap that would wear on my conscience forever.

This is absolutely disgusting, but unfortunately not that uncommon in amateur athletics all over the world. Makes it even worse when the people at the top feel that they don't have to answer to the law about this crap.
 
Heads need to roll. Not reporting a sex crime against a child is disgusting. I feel like flying to Happy Valley and kicking some geriatric ass.

There is a huge difference here. This is so much worse than what happened at CU. When Barnett found out about the party, the kids involved were punished..... The 2 recruits were never allowed back at CU and student chaperones were disciplined.

This is a conscious effort to not turn in a friend for a terrible crime. This is extremely poor judgment by individuals who should exercise a higher standard of moral judgment because of their position in higher education.

All that was required in this case was a minimal level of moral judgment. Paterno and everyone involved is human garbage. **** him and **** that operation. I'm a PSU grad and I will never root for that program again.

This story is just sickening and disheartening. Sad to see how important winning has caused some college programs to lose sight on what is important.

Could easily be the worst scandal in CFB history. JoePa's legacy is now permanently tarnished
 
How many children did he abuses after the shower incident was reported. That should have been the last one. If I were a parent and this happened to my child at any time but especially after he should have been stopped, I'd want heads to roll. Is there a statuate of limitations for a civil suit?

Only 13 years after they investigated the first incident. No need to be hasty about these things, I suppose.... :rolling_eyes:

It makes no sense to me why PSU was so reluctant to take any action against him the previous times they were confronted with the issue. Why not report him to the cops? Why not ban him from campus? Unless, of course, they were afraid it would come out that the most recognizable icon the school has had known about the issue for a long time and done nothing.... :huh:

I used to live in Pennsylvania and knew many Penn State grads. I don't think it is right to condemn the entire university just because of Paterno. This is confined to the athletic department. Let us not forget that there were many good years of excellent college football there and Paterno was clean compared to most big time programs. I do think his staying on at the school for, say, the last decade, two, three, was a big mistake. It appears he just wanted to cement his legacy as the greatest college football coach, at least in terms of wins. And in the end that will besmirch a great career. He is supposedly a fan of literature with an English degree from Brown, I think. He should go back and read King Lear!

Having the defended the school briefly, let me say that this is one of the worst scandals I have ever seen. This is MUCH worse than Barry letting guys have guns and drugs and women galore. This is CRIMINAL. And even though senility might be a deflection, Paterno is responsible in my book and needs to go. NOW!

"Difference Makers: Life Lessons with Paterno & Krzyzewski," aired on ESPN and ESPNU on June 30. Ethics were discussed. Too bad they weren't practiced.
