That sure doesn't seem like a very fast forty time for a RB.
40 times are notorious for being unreliable anyways. It all depends on who is doing the timing and who is doing the reporting. This is why college coaches like to get kids to go to a summer camp at their school and why the pros do a combine and send out their own scouts to check on guys.
There have been a lot of reported 4.4 guys who show up on a campus and are closer to 4.6-4.7 just like a lot of 6'4" guys end up at 6'1".
What really matters is football speed. Rodney Stewart is really not all that fast. I would bet that if he ran a pro timed 40 he would end up slower than 4.5, what matters is that over a ten yard space, with a ball in his hands and pads on he is as fast as anyone we have seen in a long time.
If Hayes has that on-field speed then his reported time doesn't really matter a lot.
Hayes chose Notre Dame at the end of July. CU did not end up offering.
