I feel bad for "John Doe" Had the student not been drunk, I wonder if Chadima would have gotten his ass kicked rather than just a slap.
 
Even though they didn't prosecute (yet) and likely would have a hard time doing so Penn State should take a look. Inform the police, inform the HR person in the AD, inform the Chancelor, suspend the suspect, conduct an investigation, he "resigns".

Different circumstances but at least they didn't let it go and ignore it.
