The main mouthpiece inside the UT Black Ops PR group, Chip Brown, wrote an interesting wrap-up of the whole B12 Conf re-org. He's polishing the UT turd.

Some bravado and hyperbole. UT is in his win column. CU is, of course, identified as a loser with an itchy trigger finger who was duped into jumping by Baylor. I have know idea how he gets to the $15M exit penalty number that CU allegedly owes?

Sources would later say Colorado panicked at this point because the Buffaloes thought they needed to act more quickly than the others because Baylor might be moving in on their invitation to the Pac-10. (Now, Colorado owes $15 million in buyout penalties to the Big 12 that it can't afford.)

Sources say a lot of ****. Many times, it's completely made up to advance somebody's agenda. Brown Chip makes a fantastic source when you think of it this way...

1. Colorado didn't panic. Colorado, unlike Brown Chip, was actually in contact with the Pac-10 and knew that they had no interest AT ALL in Bailer, and that Bailer was trying to bull**** and lie their way into a conference that was never going to take them.

2. Therefore, Colorado didn't act quickly out of any fear of the mighty Pooh Bears. Colorado acted quickly because Colorado has known for years the Pac-10 was a better conference for them than the Big XII, Colorado had been preparing for this all to happen since last fall, and Colorado knew their answer when they got their invitation. Colorado didn't stand around with their dick in their hands like most of the Mack-10 because Colorado's fate was NEVER linked to any other schools. Not Texass, not Bailer, not UNL. The Pac-10 wanted Colorado regardless. Colorado wanted the Pac-10 regardless. That's why Colorado was the only school in this whole mess (with the possible exception of ****braska) that could actually make a ****ing decisions without sitting around for days with their thumbs up their asses.

3. Colorado doesn't owe $15 million. That estimate must be in Beebe dollars. Probably more like $.55 to $.70 on the dollar, just like the big, fabulous new Mack-10 TV package the inmates in Bevo's asylum were sold.... :lol:

80% of a little over $9 million a year times 2 years.

The Bevo cabal is trying to interpret the Big 12 bylaws to say that even if it's 1-year notice, that it's a 2-year penalty. Therefore, CU will only receive 20% of its 2010-11 money and need to write a check for 80% of the money it has received for 2009-10.

That's not a position that's going to win. CU is maintaining that the worst-case interpretation is that CU either takes an 80% penalty for 2010-11 if we leave after 1 year ($7.5 million est.) or a 50% 2-year penalty if we leave after 2 years in 2011-12 ($9.5 million est.). But it's very debatable whether the penalty clause even applies since leaving was by ultimatum and, therefore, not voluntary. And, that leaving did not cause financial harm to the other institutions since they are splitting the same revenue 10 ways instead of 12 as they go forward and have also announced that they are going to secure a huge tv deal that CU would not have brought any value to.

But it's why both sides are seeing who blinks first. CU would like to say that we're giving 2-years notice (50% penalty worst case scenario) and then have the Big 12 say they want us to leave after 1 year. This would reduce our worst-case to about $4.75 million in lost revenue. Big 12 wants to say that CU has opted to leave after 1 year and, therefore, owes 80% of back revenue and an 80% reduction for the upcoming year.

Should be fun.
 
I sense a great deal of fear in his columns. He knows (and by extension, his handlers know) that the end is near for the Big 12. That bailing wire, duct tape and chewing gum have managed to plug the leaks, but that the foundation continues to crumble beneath their feet. CU owing $15MM - laughable. The most they *might* owe is $10MM, and that's at the very high end. I'm guessing the true number will be somewhere in the $4MM-$5MM range, and will be more than made up by a subsidy from the Pac.

Keep in mind the source here. Brown is being fed this propaganda to keep the whorn masses at bay. They have a mini revolution on their hands, and they need to do everything they can to quell it. The best way to do that is to paint us as the dimwitted morons who skipped out on all those millions of dollars. Still no word on where those millions of dollars are coming from, though. Strange how that always manages to be conveniently omitted from his stories. :huh:
 
And as usual the only ones sure to make a bunch of money off the deal are the lawyers.

I think that $15million is a fantasy number given by a bunch of people who still can't believe that CU and NU stood up to the Texas bullies. Even in the very worst case that it somehow comes to that figure in the long run CU (and NU) is way better off just getting disconnected from the Texas redneck football mafia.

It includes the $10MM penalty for telling UT to go screw themselves. Apparently, they've written in that particular penalty into the Big 12 bylaws and are trying to enforce it retroactively.

There is NO penalty...there is a liquidated damages clause that specifies a loss of X% of conference revenue in your years remaining in the league. There is nothing that says not only don't you get paid but you also owe X dollars. CU is not going to be writing any additional checks. Unfortunately this means the league does have the upper hand in the whol 9/10ths possession issue, so CU/NU may very well be forced to sue if they disagree with the league's "interepretation". I think it is HIGHLY unlikely that either school is going to buy into the idea that they are required to pay back a portion of last year's revenue distribution and they are probably expecting to receive the remainder of their revenues due as earned money as both schools provided fair notice under the bylaws.

I'd assume that if it went to court or binding arbitration it would be there, not in Texas where the league has its offices. Am I correct here?

I would guess that the bylaws probably contain something addressing where any disputes would be heard...

I'll need to read it again, but I didn't see that. It's such a boilerplate part of any agreement that I can't imagine it's not in there. I must have missed it.

I'm guessing there's a stockholders agreement that would specify venue/jurisdiction.
 
this is going to drag out for a long time. The contract was very poorly written and will take a long time to sort out. our best bet is to leave the Big 12 after next year and give them a one year notice, then they can come after us for more money and we can give them the finger.

i'm hoping CU and Nebraska get on a united front and fight this deal. The penalty for leaving should be enacted when their is damage to the conference. THey got a better TV deal post those two schools and many people have been on record saying that the conference is better off, including parties from Mizzou and OSU.
 
It would almost be worth an extra few million dollars to see Dodd, Beebe and the rest of the Bevo cabal have to go on record saying that Colorado leaving the Big 12 has financially harmed the conference and its members.
 
This will settle, no one is going to take this to court. It won't be $15M and we won't get off for free. At the end of the day we'll pay $4-5M and the Pac will loan us the money against future revenues and everyone will move on.

As much as I hate Dodds, Beebe, and Chip Brown - we don't want to get in a protracted legal battle with them. Besides, it's entirely possible that UT ends up in the Pac 12 two years from now so I don't think either side wants to completely burn those bridges.

Not sure if the B12 is incorporated in Delaware or not. However the laws that govern incorporation are by far more favorable in Delaware than any other state.

Favorable for officers and directors, not necessarily for members (or stockholders - although I doubt the big xii is a stock corporation).

If there is no forum selection clause in the conference agreement, we might very well see a race to the courthouse, thereby giving the winner of the race a leg up on the forum. CU and NU certainly don' want to litigate in texas.
 
Given how texas centric everything else was I's FLOORED if texas wasn't the venue for disputes.

Jeebus who cares anymore. I say Nebraskans and Coloradans meet at the border and have a big lemonade stand and raise money to pay off Tex*****. Any amount of money will be worth it to be rid of those dirtbags.

More to the point I don't think Texas, or most of the other parties, wants any part of a detailed discovery process that could air all the dirty laundry that occurred as a result of the back room politics and negotiations.

Honestly, f*** Texas. They tried to piss on us and have us thrown out of the Pac 10 expansion in favor of Baylor. While i'm not against paying a reasonable exit penalty (we put in two year's notice, they want us out after 1, we pay our 1st year amt, they waive year 2), i'm not a fan of ever bending over for Texas and if they want to battle it, then go right ahead. I think they would like to stick it to CU more than Nebraska anyways. They think we're the weaker of the two parties and they can make an example out of us. Tell em' to shove it.

Piss on anything Texas when it's college football related.
