SI: CU Assistant Coach's Victim Seeks Justice

she did go to the police, did you even read the article?
Because cu can't really do anything since she isn't going to the police. So mac most likely told Joe about it and he got a lawyer and the lawyer tried to settle it so it wouldn't go public.

The University can only communicate with people when they involve law enforcement? That makes zero sense. They easily could have reached out to her, explained that they were looking into the allegations and ask that all further communication be through the CU attorney. That would have been the decent thing to do.

My question is why was Tumpkin's defense attorney the first person to contact her after she spoke with Mac? Even if they wanted to keep Mac out of it, a CU attorney could have reached out to her and said that they were looking into it. That would have been far more palatable than Tumpkin's defense attorney.

"She assumed, rightly, that Banashek was the go-to defense lawyer for CU Football. A Google search would later reveal to her that Banashek had represented Buffs defensive back Jeffrey Hall, who pled guilty to two felony charges after assaulting a female CU student at a party in Feb. 2014; and Donald Gordon, one of two Buffs players who pled guilty to felony burglary earlier in 2016 after being caught on tape stealing codeine and electronics from a dorm room. Banashek had also represented Josh Tupou, a 300-pound, NFL-bound lineman"

Show me where it says that Banashek is an employee of the University of Colorado.

By all means, let's fire MM and give CU the death penalty.

RG and MM should have suspended tumpkin earlier and he shouldn't have been coaching the bowl game.

Tumpkin is an ahole for what he did to her and will get what is coming to him. I hope she can recover from this and have a happy life.

But stop with the lynch mob bs, save that for bailer.

Little concerning how RG didn't really seem to look into this himself though.

1.) MM should have never had Tumpkin be the interim DC after learning about this issue. People just don't call a HC at a University and say so and so has been beating me without good reason.
2.) The fact that Banashek was the first person from CU to reach out to the victim is slimy as ****
3.) Plati lying to the media saying he didn't learn about it until the media dropped the story is slimy as ****
4.) Banashek's attempt to sweep this under the rug is slimy as **** "He kept asking, What is it that you want?” Jane recalls. “He must have asked me that ten times."
5.) Banashek again "“He asked if I would do him a favor and give him a heads up before I flew to Colorado to meet with police. I asked: Why I would do that? He said that it would just help him with his job.” " wow more slime
6.)“Mr. Banashek said that Mac wouldn’t be taking my calls anymore because he didn’t want to be called in as a witness.” wow that's pretty pathetic

should I keep going? can't wait to see what Tschek spins up!

As I read this it amazes me you cannot grasp the relatively simple fact John Banashek does not work for CU, nor did he represent CU. He represented Tumpkin.

1) While this is a good rule of thumb, and I agree with you, at this point in time it was the victim's word against Tumpkin's. This is probably the only thing I wish CU had done differently. You don't have to suspend him right away, but don't promote him either.
2) Banashek does not work for CU, but is a DA doing his job as a DA.
3) Plati may have been kept in the dark about this. Quite possible that Mac told RG who told DiStephano and that was as far as it went.
4) Banashek does not work for CU, but is a DA doing his job as a DA.
5) Banashek does not work for CU, but is a DA doing his job as a DA.
6) Banashek does not work for CU, but is a DA doing his job as a DA. Also Mac was probably instructed by his legal counsel and/or by his boss to cut contact with the victim as to not involve the university in a criminal investigation. Like it or not, that is smart business.

LMAO! you think Tumpkin cracked open the yellow pages and started calling lawyers? He was advised by "CU" who to contact which was Banashek

This was an absolute no win situation for anyone involved, no right way to handle it.

Bottom line is that before specific details went fully public CU first suspended then fired Tumpkin, they were not trying to hold onto an abuser, thankfully.

It does look bad in the media but there was in hindsight no safe way to handle it. When the information initially came in to CU it was unverified. Tumpkin was in a very public position. For the same reasons I felt he should be fired being a highly paid and highly visible state employee they also have to be sure that the evidence lines up and they are acting correctly. If not you have a big mess on your hands and a potentially ruined career.

Most importantly was the woman in danger during this time. If she was they acted to slowly, since she apparently wasn't then taking a reasonable amount of time to sort it out and make the right decision is appropriate as long as you come to the right decision in the end.

Not surprising that SI would slant this as a hack job, that is what they do and Plati has never been able to manage that kind of thing. If what was stated earlier in the thread about the author of the piece being from the U of Nebraska then it is simply sadly ironic considering that universities history of failing to support women victims.

I'm trying to figure out what she wanted/expected Mac to do. He was in a precarious spot legally.
Clearly, on the basis of one phone call, he was supposed to interject himself into a domestic dispute, without the benefit of any other facts, fire his asst. coach, run the risk of a wrongful termination suit, potentially poison his reputation as a head coach to work for, jeopardize his own job and make himself a potential witness in a possible criminal matter. Really, it would be the only decent and prudent thing to do.

And you know this to be a fact how? For all you know, he could have known Banashek represented players, and that general knowledge was what led him to Banashek. The truth of the matter is neither you nor I know how Tumpkin got to Banashek. I think I am done here, you really don't have much of a grasp on reality, just an agenda. Have a nice day.

Once again on the "promotion"... what should CU have done differently? He was the highest ranking member of the defensive staff. To not promote him would have raised questions they were not prepared to address.

The guy was eventually fired.

I think Mac could have easily taken playcalling duties for the game and it would have avoided those questions.

I have no agenda. It's unfortunate and slimy how CU handled this situation. I have no sympathy for domestic violence perpetrators but I do have sympathy for domestic violence victims. You know who's taking the L here? CU and the posters defending CU/MM/RG/Tumpkin

If Mac had taken DC responsibilities for the game. No questions would have been asked. Especially given his background as an award winning DC.

Not a single person on this board is defending Tumpkin. None.

Plenty of people in here are unhappy with how CU handled this but realize that the situation is not as black and white as we would all like it to be.

Go join your lynch mob friends, something tells me you've had a sack over your head for a long time.

Jesus, is this really that difficult? Banashek is a private defense attorney who does not represent the University of Colorado. He may have ties to the program and he may even do pro-bono work or cut deals for players and staff when they get jammed up. Since Tumpkin's actions did not occur in his capacity as an employee of the University of Colorado, he is required to obtain his own private council. The fact that there is an appearance that the staff communicated with Tumpkin's private attorney who then contacted the victim is what is the problem. They could have saved themselves the image issue by having a CU attorney reach out the victim and inform them that they were the point of contact for Mac.
