I hear you. I don't disagree with you. That's the emotional, but perhaps not the rational legal response.

I would gladly pay to keep this out of the papers and lingering for the next two years casting great questions on CU and victimizing MM and RG at every turn.

Benson is smart. Let Salazar handle it.

Settle.

Looking at it the other way, it is an admission that the proper institutional controls were not in place and key employers did not act appropriately which potentionally put her at additional risk as well as future students and employees.

Her lawyer could very well be joined by a Title IX expert lawyer. No reason to suffer through this.

Settle.
 
A few thoughts:
  • CU was always going to be sued and have to settle with this woman. She's asking for $3.2, I think the report helps get that number to a manageable settlement.
  • The big failure IMO was not involving University Counsel immediately. They would have involved the IOEC appropriately.
  • I still believe that Macs actions were influenced by being short staffed on defense. If Leavitt and Clark don't get hired away, I think this plays out differently.
 
Benson statement emphasizes
- apology to victim
- admission of fault
- ownership of responsibility
- letters of reprimand
- modification to employment contracts
- commitment to fill gaps in training
- commitment of six figure donations by RG and MM to agencies addressing domestic violence
- PD 2 week suspension & salary amount directed to domestic abuse agencies
- acknowledgment that AD picks up all expense for this investigation
- recognizes no one will be happy with decision

Out of bounds - not mentioned
- importance of role that athletics serves within the university and community
- clear statement about impact on taxpayers dollars, other public funding, tuition, and student fee usage relating to this outcome
- indication of how CU's process and decisions relate to the broader context of collegiate athletics.
- public bid of confidence in his subordinates and the value that they add to CU
- indication that performance of subordinates is a factor in deciding to retain otherwise exceptional talent
- acknowledgement of MM's deferred contract extension



Open question - by deferring the new contract, has CU paid MacIntyre less money? ($2M annual increase = 166K/mo x 4 mo. Estimate MacIntyre may have lost ~$666K from the delay caused by the investigation)

I have to imagine that he will be compensated retroactively. The actionable decisions have been made and really should not influence the contract renewal at this point.
 
Frustrating and sad situation. Proud of CU for taking the situation seriously and objectively evaluating the systems in place. I sincerely hope the steps now will serve to protect others in the future. DV such a sad reality in our society.

Oh yeah, and ****bailer, that rape infested, cover up promoting, Title IX lacking cesspool
 
Most employers would have just hung up on the woman.
"Some" might have directed her to call the police before hanging up on her.
Amazing how an accusation can turn into such **** storm with these kinds of complications, money and discipline.

Gross. The notion that she set up MM is as preposterous as the notion that CU should pay her damages for two years of abuse. If anything, I'm under the impression that a large chunk of her resentment is hurt stemming from MM's delay in forcing action. She believed the MacIntyre's genuinely cared for her (and they very likely did). That's not a set up.

As an aside, MM is taking it on the chin here for being kind and compassionate. If Tumpkin were on Saban's staff the victim never makes the call to the head coach.
 
Every smart guy knows exactly how Mac should've handled this. "Why, if it were me, I'd have immediately contacted the police!!" Yeah. Right. They never consider the inner turmoil that one would go through in a situation like this. "Should I call the police? But what if she's lying? I could destroy a guy's career. She begged me not to. She told me she's in a safe place," and on and on.

We always know what should've been done, don't we?

No doubt, difficult. But sometimes the right thing and the hard thing are the same thing.

Considering the evidence in the case hasn't been presented and a jury hasn't had a chance to reach a verdict, how can anybody be positive that he is guilty? He hasn't plead one way or another has he?

I am sure the CU administration knows if he did this or not. If he wasn't guilty they could have handled this all internally but since the information is likely to come out in his trial and since they are suing the school they had to make the information public.

But if this situation were to happen today, betcha that the results would be different.

I don't believe there has even been a police report or a medical report we've seen. And with CU we have seen players suspended or dismissed despite the DA not even choosing to bring charges after they were accused.

Because it has nothing to do with Tumpkin's crime, but rather how people at CU responded when told of Tumpkin's crime. These are related yet separate issues. This is about process, not judgement.

That could happen I just don't see the admin releasing info about their handling of the accusations unless they knew he did it and was going to be found guilty.

Definitely weird that she told SI she told Mac about the choking and biting but then he said that was not part of the conversation though.

And they already came out with a statement in January/February about the process changes. The specifics of the investigation didn't have to be made public unless they were likely to come out at a later date anyway.
