Why don’t the women’s basketball team get cars? Or walk ons who start? Anyway, this kind of stuff is going to escalate unless it becomes regulated. Pro sports leagues at least have salary caps except for MLB.
See my post above. Pro sports leagues have drafts and don’t allow players to choose where they go until free agency. That’s the material difference.

Also, women’s basketball players and teams don’t get cars and money because the people footing the bill don’t care about it (mostly)
 
I don’t think you can stop under the table payments in any structure that still allows for free choice for the players of where they play. So yeah, even if they regulate NIL, the under the table stuff will likely continue. Even if they shift to a salary model when players are deemed employees, there will still be skirting the salary cap in order to entice players to come to their programs.

The only way it becomes “legit” is if the 48+ schools break away and form a league like the NFL where they institute a player draft.
The employee model is also something they don't want because it will be a death blow to division 2 and 3 athletics. It will also knock out some division one athletics as well.

You're opposed to market value? Weird, since I've never heard you argue for salary caps for coaches or executives or pro team owners. Maybe I missed it and you're not only targeting the people who actually deliver the entertainment we cheer for and emotionally engage in.

Thing is, and my point was, their NIL deals exceed and have nothing to do with fair market value.
What you mean is that their true NIL market value is less than what they are actually being paid for, which is the fair market value of their football playing abilities
 
So if a 3 star guy is being recruited by Alabama, and they “guarantee” that he will sell 5,000 tee shirts with his name for $100 a shirt, that is not fair market value. It’s a money scam to pay a player.

When you look at the NCAA’s policy for NIL when it first began, the NCAA stated that they would evaluate NIL deals to assure that players were not getting paid more than anyone else would get paid for a similar service. Of course, that was something that the NCAA could never be able to police and they never will.
 
I won't be giving to 5430 or any other NIL collective. First I don't believe these are legitimate charitable entities. They may have that status now but I think it will be short lived. 2nd NIL is a business expense. If this was being done to serve that legitimate purpose, someone would be beating down the businesses in Boulder and surrounding communities showing how much a successful team brings in extra revenue and getting them to sign contracts for advertising where the agency then signs the players and provides them for advertising.

I really hope Congress steps in and clarifies this mess.

I never said that nor implied that. I’m just saying that the combination of NIL and the Portal needs a structure. It needs enforceable rules and it needs to be regulated. Right now it is out of control.

The original intent was that players could make money off of their NIL on the open market and the schools could not be involved. But then schools pushed the limit and created these collectives. That was never the intent.

And you also have the danger of young people being lied to and taken advantage of. Unscrupulous and/or unqualified people want some of the pie as well and are willing to use these kids to make money.

This is the model I wish we would use! Businesses could have commercials with the players. Charity events are great, but should tie to businesses and the charity. All together promotions. Have not seen a single thing yet promoted.

The NCAA backed off after O’Bannon and Alston. They’d get the crap sued out of them if they tried to regulate. And they’d lose.

I mean regulate the school and NCAA involvement. If McDonalds wants to pay Caleb Williams to do a commercial, great. But if boosters and schools are promising advertising money to recruits to entice them, I have an issue with that.

Why? If someone is willing to pay, they should be able to. Businesses and individuals make stupid decisions with money all the time (hello crypto), and that’s their right. No different with paying more than what you view as their market value.

I'm fine with that as a profit share for players as a percentage of certain revenues. I don't know how you say, for example, that Caitlin Clark is capped on how much State Farm can pay her.
 
Salary cap won’t work. As long as the players have full choice of where they play, there will always be under the table payments/enticement.

There are chances for reform: 1) federal legislation; 2) collective bargaining with unionized players.

I think 2) more likely than 1).

3) Weirdos being around is why players need representation. It doesn’t mean that we should stop the free market.
